Release of Liability and Agreement to Terms and Conditions Hell Week Bicycle Adventures Note: All Hell Week entrants must agree to the terms of this waiver. Online registration signifies acceptance of these terms and conditions. In consideration of the acceptance of my application, entry fee, and/or desire to be a cycling participant at Texas Hell Week (10-17 March 2012) in Fredericksburg, TX, or Gator Country Hell Week (28 Dec 2012 - 04 January 2013) in various Florida locations, or Cheese Country Hell Week (July 2011), held in Richland Center WI, hosted by Nick and Becky Gerlich dba Ultra Sports Marketing, I hereby waive, release, and forever discharge any and all rights and claims for damages for death, personal injury, or property damage which I may incur, or which hereafter may accrue to me as a result of my participation. This release is intended to discharge in advance the promoters, the sponsors, the officials, the volunteers, and any involved municipalities or other public entities (and their respective agents and employees), from and against any and all liability arising out of or connected in any way with my participation in said event, even though that liability may arise out of negligence or carelessness on the part of the persons or entities mentioned above. I further understand that it is possible for serious accidents to occur during bicycle riding to anyone connected or not connected with the event, and that an entrant could conceivably be injured by a cyclist, person or criminal action, other vehicle, or acts of nature like tornadoes, rain, cold, heat, or any other injury-producing situation, and sustain mortal or serious personal injuries, and/or property damage, as consequence thereof. I understand that Hell Week events will take place on roads with traffic, pedestrians, other cyclists, cattle guards, livestock and water crossings present in some locations, and I understand that these require extra precaution on my behalf. Knowing the risks of bicycle riding, nevertheless, I hereby agree to assume those risks and to release and hold harmless all of the persons or entities mentioned above who (through negligence or carelessness) might otherwise be liable to me (or my heirs or assigns) for damages. I agree to follow the precautions for Hell Week as published in the Registration Package given to each entrant upon their arrival prior to the beginning of the event. I hereby agree to abide by the highway laws governing the usage of a bicycle in the state, counties and municipalities traversed for this event. It is further understood and agreed that this waiver, release, and assumption of risk is to be binding on my heirs and assigns. I understand that photographic, electronic, or other records of my participation in this event may be used in future promotional materials by the promoters, including on the Internet, brochures, advertising flyers, and t-shirts. All cyclists must wear an ANSI-approved helmet whenever riding the bicycle.
